Students Being Charged With Title IX Violations

What is Title IX?

If you have a child in college, or perhaps you are attending college, you have probably heard about Title IX. Title IX is a civil right that prohibits sex discrimination in education. Title IX was once only associated with providing females equal access to sports, but it has been expanded considerably to prohibit discrimination against women in all areas of education - including being free from sexual harassment and sexual violence. Such claims can arise from off-campus or on-campus harassment or discrimination, as long the incident can be connected to an education institutional or activity. It sounds simple, but it is very complex.

Rise in Title IX Complaints

There has been a sharp increase in college Title IX complaints within the last five years, according to the Department of Education. Most attorneys representing clients charged with sexual offenses are seeing more male students and male faculty being charged with Title IX violations - for engaging in sexual acts.

Quite often, these men believe they were engaging in consensual sex, or perhaps they thought they were engaging in common banter between men and women. In either case, a simple mistake can lead to a criminal accusation and disciplinary measures by the university. Most often, a male first hears from the local police or the university, that they are being investigated for some prohibited behavior - and at that moment, everything changes. When you are under investigation or being accused of sexual misconduct, you should always learn your rights and how to conduct yourself during the investigation by talking to a knowledgeable Title IX defense attorney early on in a case.
