Shoplifting Defense Lawyer in Richmond

There are two key steps to take if you are arrested and taken into custody for allegedly shoplifting. Remain silent and demand an attorney. You have the right to remain silent and you have the right to have an attorney present during any questioning with the police. Choosing to exercise these rights at the very beginning of your case may offer your lawyer a much better opportunity of positively impacting your case.

With a Richmond shoplifting lawyer from our firm to handle your shoplifting charges, you can rest assured that your rights will be fully protected. We are highly experienced in handling all types of theft crime cases and can use our resources and knowledge to build a compelling case against the government's charges.

Petit Larceny - Charges & Penalties

Shoplifting offenses typically fall under petit larceny, a crime defined in Virginia Code 18.2-96 "Petit larceny defined; how punished." Committing simple larceny of goods valued at less than $200, not from the person of another, is a Class 1 misdemeanor. A defendant may face up to 1 year in jail for this offense.

If a defendant is accused of taking property valued at more than $200, however, he or she may face felony charges with a maximum sentence of up to 20 years in prison, depending on the type and amount of property involved. A defendant may also face felony shoplifting charges with two prior misdemeanor larceny convictions on his or her record.

Richmond Defense Attorney for Shoplifting Charges

Whether you are facing misdemeanor or felony shoplifting charges, you should consider involving a lawyer as quickly as possible. At first, you may think that your only chance of avoiding maximum penalties is to accept a plea bargain. You may be surprised to find that you have a fighting chance of avoiding a conviction. For example, what if the items you are accused of taking were discovered on your person or your property as the result of an illegal search? Your attorney may be able to use this to have that evidence suppressed, and this can turn the entire case around.
